Awesome Pawsome Pet Supplies Terms and Conditions By placing an order with us, you are making an offer to buy goods, which once received and processed (by us) we will acknowledge, via email confirmation, thus forming a contract between Awesome Pawsome Pet Supplies and yourself, the customer. This contract will be executed in accordance with the following terms and conditions. In the following policy “we and our” will refer to Awesome Pawsome Pet Supplies, and “you” will refer to you, the customer. Terms of service: The following terms and conditions apply to all customers using our website and placing orders with us. Any questions relating to the terms and conditions, our website, product enquiries, comments, or complaints should be sent in writing to info@awesomepawsomepetsupplies.co.uk 1. Contract and acknowledgement of sales order: When you place an order via our website, full payment for the goods must be made, before the order is accepted. You will need to provide an email address, so that an email confirmation can be sent, following receipt of full payment, to confirm the contract of sale between us. This will become legally binding at the point the goods are dispatched. 2. Customer cancellation rights: In line with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/2014, you have the right to legally cancel your order up to 14 days after the day on which you receive your goods. This does not include items that are bespoke, personalised or perishable. You do not need to provide justification for cancelling your order, and it will not affect your statutory rights. To cancel your order you must notify us in writing by emailing info@awesomepawsomepetsupplies.co.uk. If you have received your goods prior to cancelling, then you must return the goods to the contact address that will be provided to you once you inform us of your wish to cancel. The goods must be returned to us at your own cost and risk. If you cancel your order after the goods have been dispatched, but before they arrive, then you should not unpack them on receipt and send the goods back to the contact address as soon as possible, at your own cost and risk. Once we have received the goods, or received evidence that you have sent the goods back, we will refund the sum owed within 14 calendar days; minus any deductions for loss in value to stock, or missing items. 3. Cancellation by us: We reserve the right not to process your order if: we have insufficient stock to meet the ordered quantity, we do not deliver to your area, or if one or more of the goods you ordered was listed at an incorrect price due to typographical error, or an error in the pricing information received by us from our suppliers. If we are unable to process your order for any reason we will contact you via email, and re-credit you any sum deducted by us as soon as possible, but within 14 calendar days. 4. Ordering errors: You are able to alter your order up to the point you click on “submit/confirm” during the ordering process. Any alterations required after this point will have to be submitted via email to info@awesomepawsomepetsupplies.co.uk and treated as a cancellation. We recommend contacting us via our “contact us” form, or via email with any product enquiries, or questions before pressing confirm/submit. 5. Accuracy of content: Care is taken that all stock quantities and prices of products listed, on our website, are up to date and accurate at the time of publishing, with descriptions of the goods provided. Any weights, dimensions, or colours of the goods are approximations only and subject to subtle variation. 6. Pricing: The prices payable for all goods, including VAT where relevant, are listed on each product page and are correct at the time of entering the information and publishing. The cost of delivery will be calculated at the point of checkout, in accordance with our delivery, returns and refunds policy. For any instances where it is not possible to accept your order to buy goods of the specification, description and/or price indicated, we will advise you by email, and make an offer to sell you the goods of the specification, description and/or price stated in the email, and inform you of the period for which that offer remains valid. 7. Payment: We will take payment, through our website’s payment services provider, upon receipt of your order. Payment will be debited from your credit, or debit card. We accept no liability if your order is delayed due to non- / declined payment, resulting from incorrect payment details. If it is not possible to obtain full payment via your credit or debit card, please email info@awesomepawsomepetsupplies.co.uk to discuss payment via bank transfer. Your order will not be accepted at this time, and the goods will remain subject to availability until payment has been received. Once full payment has been made an email confirmation will be sent 8. Delivery: Delivery charges will vary depending on the type and quantity of goods ordered. Delivery charges are set out in our delivery, returns and refund policy. Delivery to certain areas may not be possible, and others may incur additional charges. In these situations, we will contact you via email to provide you with the necessary information for your order to be processed. If at this point you no longer wish to proceed with your order, it can be cancelled, and a refund issued to the sum of the goods ordered. To avoid disappointment please ensure you check the delivery, returns and refunds policy prior to placing your order. For any questions regarding delivery locations please contact info@awesomepawsomepetsupplies.co.uk. We will deliver the goods to the address specified by you for delivery in your order. We are not liable for wrong delivery due to incorrect, or typographical errors in the delivery address provided. Please be specific on where you would like your goods to be delivered if you are out. We will not be held liable for loss of, or of damaged goods, once they have been delivered in accordance with your instructions (unless this is caused by our negligence). We will aim to deliver the goods within the time frame provided as per our delivery, returns and refunds policy, but delivery times are not guaranteed. If delivery is delayed beyond 30 days from the date your order was accepted, following receipt of full payment, we will contact you and either agree an alternative method, or date, or delivery, or offer a refund for the sum of the goods ordered. You will become the owner of the goods ordered once they have been delivered. After delivery has been made the goods are held by you at your own risk, and we will not be liable for any damage or loss. 9. Gift vouchers: The purchase of gift vouchers is excluded from all promotions, sales and discounts. Gift vouchers can be used in conjunction with other offers, unless otherwise stated on the product, or promotion page. 10. Computer safety: Whilst we take steps to ensure that this website is free from viruses, or defects, we cannot guarantee that your use of this website, or any websites accessible through it, will not cause damage to your computer, or other electronic device. It is your responsibility to ensure your equipment has appropriate safeguards and protections in place in order to use this website. We will not be liable to any person for any loss, or damage which may arise to a computer, or electronic equipment as a result of using this website. 11. Liability: We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions. We do not accept liability if we are prevented, or delayed, from complying with our obligations as set out in these terms and conditions by anything you, or anyone acting under your implied authority, does, or fails to do, or is due to events which are beyond our reasonable control. We are not liable for any losses related to any business of yours including, but not limited to lost data, lost profits, lost revenues, or business interruption. It is your responsibility to observe and comply with all necessary regulations and legislation, including obtaining all necessary customs, import, or other permits to purchase goods from our site. The importation, or exportation of certain of our goods to you may be prohibited by national laws. We accept no liability, and make no representation, in respect of the exportation, or import of the goods you purchase. Notwithstanding the above, nothing in these terms and conditions is intended to limit any rights you might have, as a consumer under applicable local law, or other statutory rights that may not be excluded, nor in any way to exclude, or limit our liability to you for any death, or personal injury resulting from our negligence. You have certain rights as a consumer including legal rights relating to faulty, or misdescribed goods. 12. Notices: All notices, unless otherwise expressly stated, from you to us, must be in writing to info@awesomepawsomepetsupplies.co.uk. All notices from us to you will be displayed on our website. 13. Changes to legal notices: We reserve the right to change these terms and conditions, from time to time and we recommend reading them through as often as possible. 14. Law, jurisdiction and language: This website, all content contained therein, and any contract brought into being, as a result of using this website, are all governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English. 15. Invalidity: If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms and conditions will not be affected. 16. Privacy: You acknowledge and agree to be bound by the terms of our privacy policy. 17. Third Party Rights: Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
